If you are charged with a DUI, you must act within 10 days from the date of your arrest in order to keep you driving license from being suspended or revoked.  You must request a hearing within 10 days or your license may be suspended for up to 1 year.

Mr. McIlhinney graduated cum laude from North Carolina State University in 1991 and completed law school at Georgia State University in 1995, where he again graduated cum laude and was a member of the Law Review.

Upon graduation, Mr. McIlhinney accepted a position at King & Spalding, the premier law firm in Atlanta and the Southeast, where he worked for approximately three years in the Products Liability Department as a litigator representing clients such as General Motors and Brown & Williamson (a tobacco manufacturer) in national high-profile/high-stakes cases.


In late 1998, Mr. McIlhinney opened his practice, deciding to fight for justice by representing individuals arrested and accused of DUI and crimes and people injured in accidents. Mr. McIlhinney has won numerous bench and jury trials in both the criminal and civil arenas. He has negotiated numerous DUI cases and had them either reduced to a lesser offense, such as reckless driving, or dismissed. 

Mr. McIlhinney has handled jury trials involving DUI, hit and run, vehicular homicide, civil fraud and racketeering, and personal injuries. He has also won appeals in the Georgia Court of Appeals, Northern District of the United States, and Federal Court, 11th Circuit.  
 
Mr. McIlhinney has handled several large personal injury cases for clients—two of which each resulted in a settlement or verdict in excess of $1 million and numerous cases that have resulted in a settlement or verdict in excess of $100,000. He has represented professional athletes and Olympians in criminal and civil cases, as well as attorneys and police officers accused of criminal wrong-doing.  

Mr. McIlhinney handles traffic ticket cases for all drivers—especially Commercial Drivers, Under 21 Drivers, North Carolina drivers, and Out-of-State drivers who are unable to make court. He has an amazing understanding of the Traffic Code and how to secure a disposition for a ticket so that it will not be reported to the DMV or cause license suspension.  

Mr. McIlhinney is married and has three children.  He is affectionately known as the DUI PRO and Traffic Ticket Pro by attorneys and clients alike.
