THE GEORGIA “POINTS” SCHEDULE FOR SPEEDING OFFENSES

O.C.G.A. § 40-5-57 provides a schedule for the assessment of “points” against a Georgia driver’s license.  Below is a listing of the points which are assessed for speeding offenses in Georgia under O.C.G.A. § 40-5-57 for each offense: 

  • Exceeding the speed limit, 14 MPH < Violation < 19 MPH = 2 points
  • Exceeding the speed limit, 19 MPH ≤ Violation < 24 MPH = 3 points
  • Exceeding the speed limit, 24 MPH ≤ Violation < 34 MPH = 4 points
  • Exceeding the speed limit, 34 MPH ≤ Violation = 6 points

If you are an out-of-state driver, points are not assessed against your driving record the Georgia Department of Driver Services. However, the Georgia Department of Driver Services generally reports all speeding citations to the state which issued the driver’s license and the license issuing state will assess points or penalties in accordance with that state’s law. North Carolina drivers, in particular, should consult an attorney prior to paying any speeding citation received in Georgia.

Remember that, although a nolo contendere plea may be beneficial in certain cases, such as to avoid a suspension for points accumulation, a nolo contendere plea will not keep an insurer from factoring in the offense when it is time to determine your premiums.
